Maintenance indexation in The Netherlands for 2025
The Dutch government has announced that all maintenance obligations will be indexed by 6.5 % as of the 1st of January 2025.
Child maintenance and partner/ spousal maintenance are automatically indexed by law on a yearly basis in The Netherlands. The indexation is applicable to court orders as well as maintenance agreements. The automatic indexation can only be waived by either a written agreement between parties or a (new) court order.
Maintenance is indexed even if your original agreement does not contain any indexation clause. The raise is enforced by law and if you have not applied indexation before, payment can be demanded for up to five years previously.
Previous percentages
The percentages for previous years:
- 2021: 3.0 %
- 2022: 1.9 %
- 2023: 3.4 %
- 2024: 6.2 %
Due to higher inflation, the index correction was already high in 2024, but will be raised substantially again in 2025.
